1. No Warranties
PongDesk is provided "AS IS" and "AS AVAILABLE" without warranty of any kind, express or implied. We make no representations or warranties regarding accuracy, reliability, completeness, fitness for a particular purpose, or non-infringement. Use of this software is entirely at your own risk.
2. Limitation of Liability
To the fullest extent permitted by law, PongDesk and its contributors shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of - or inability to use - the service. This includes but is not limited to loss of data, loss of revenue, tournament disruptions, registration errors, or any other harm, even if advised of the possibility of such damages.
3. No Uptime Guarantee
We do not guarantee that PongDesk will be available, uninterrupted, or error-free at any time. Scheduled or unscheduled downtime may occur without notice. You are responsible for maintaining your own backup records of critical tournament data.
4. No Data Guarantee
While we take reasonable measures to protect stored data, we make no guarantees regarding data retention, integrity, or recovery. We are not liable for loss or corruption of tournament records, player information, match results, or any other data stored in or processed by the service.
5. Service Changes & Discontinuation
PongDesk reserves the right to modify, suspend, or discontinue the service - or any feature thereof - at any time, with or without notice. We are not liable to you or any third party for any such modification, suspension, or discontinuation.
6. Third-Party Services
PongDesk integrates with third-party services (e.g., payment processors, authentication providers). We are not responsible for the availability, accuracy, or terms of those services. Their use is governed by their own terms and privacy policies.
7. Your Account & Acceptable Use
You are responsible for keeping your account credentials secure (including credentials for third-party login providers like Google) and for all activity that occurs under your account. You agree to use PongDesk only for legitimate table tennis tournament management and not to misuse it - including no attempts to disrupt, overload, scrape, reverse-engineer, or gain unauthorized access to the service or other users' data.
8. Player Data You Provide
Tournament managers can enter information about other people (for example, names, birth years, ratings, and gender) when importing rosters or adding managed players. If you enter another person's data, you represent that you have the right and any necessary consent to do so, and that the information is accurate. You are responsible for handling that data lawfully. See our Privacy Policy for how PongDesk stores and processes it.
9. Minimum Age
You must be at least 18 years old to create an account. By registering, you represent that you meet this requirement. Minors may participate in tournaments as players - their data is entered by a club manager or parent/guardian who accepts responsibility for the accuracy and lawfulness of that data.
10. Governing Law
These terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-law provisions. Any disputes arising under these terms shall be resolved in the courts of Texas.
11. Acceptance
By accessing or using PongDesk, you acknowledge that you have read, understood, and agree to these terms. If you do not agree, do not use the service.
